Warning
A warning is issued by the employer if an employee has behaved in breach of contract. In a warning, the employer must explicitly describe the misconduct and also point out that there is a threat of dismissal in the event of repeated misconduct.
The warning can be issued verbally or in writing, although the written version is more appropriate for reasons of proof.
It is particularly important that any breach of the employment contract must be verifiable. Evidence includes, for example, a written statement by the persons involved. The following misconduct is usually easy to prove:
- Alcohol & drugs in the workplace
- Theft
- Missing sick note
- Constant unpunctuality
- Vacation overdraft
- Working for the competition
- Violation of safety regulations
