Trial period
The probationary period is a prescribed period set out in the employment contract. During this period, the conditions for terminating the employment relationship are much simpler.
It serves as a kind of test phase so that both sides can get to know each other better.
Termination during the probationary period
The special feature is that there is no protection against dismissal during the probationary period. Accordingly, no reasons need to be given to terminate the contract. A written two-liner is sufficient notice of termination.
In addition, a shortened notice period of just 2 weeks applies to both parties.
Is there a legal obligation?
Incidentally, there is no legal obligation for a probationary period. Therefore, if no probationary period has been agreed in the contract, these regulations do not apply.
The only exception is vocational training. Here, the Vocational Training Act stipulates that a probationary period is mandatory.
Duration of the probationary period
Employees and companies are free to choose the duration. The maximum duration is 6 months and the 6 months are often fully utilized. There is also an exception for training in this case, as the period is between one and four months.
Vacation during the probationary period
There is one special feature during the probationary period and that is the entitlement to full annual leave. This entitlement only applies after 6 months of employment.
What happens in the event of illness?
If an employee falls ill during this period, this does not immediately result in dismissal. Likewise, the period is not extended by the days of absence due to illness. It should only be noted that the salary is only paid after a period of at least 4 weeks, even if the employee is absent.
Is an extension possible?
An extension of the probationary period is only possible if the employee was unable to work for a long period during this time. At the end of the probationary period, the employer can accordingly draw up a fixed-term contract.
